Compliance is the process of ensuring that you are meeting all of your legal requirements. I have a set of tools that perform this analysis with an emphasis on California based laws and regulations. During a compliance audit, I evaluate all aspects of your business to ensure compliance. At the conclusion of the audit, I provide a comprehensive audit report with action items (if necessary).

I strongly recommend that businesses perform an annual compliance audit. If you fail to find legal problems that are just brewing for years, the liability grows. Most people find that it is far better to get in front of potential legal issues before they explode into large problems that may overwhelm your business and management team.

My compliance service is an asynchronous dynamic multi-tiered/focused service solution that reduces or eliminates threats of litigation and the underlying legal expenses. This is accomplished by first, converting your business into a set of useful variables that my proprietary software manages. Next, as I am constantly monitoring changes made to statutes, regulations and court decisions interpreting the law, these are also reduced down into a set of variables. By combining both sets of variables, I can effectively project your risks and provide counsel on adjustments to your practices that are necessary to prevent litigation. The actual compliance engagement is typically broken down into three stages, namely Analysis, Resolution and Monitoring.

Often times each stage is running asynchronously from the other stages. Or another way to think about it, is as certain aspects of Analysis are completed, Resolution and Monitoring may already be operating independently. The overall result is an outcome where you can truly find peace of mind, secure in the knowledge that compliance insulates you from litigation and threats of litigation.

While nothing is completely foolproof (and certainly torts can happen to anyone at any time), after my compliance service starts working for you, you will have a greater understanding of your risks and exposure. Finally, once all resolution strategies and monitoring are in place, you really will be as protected from litigation threats as is reasonably possible.

Frankly, it is simply bad business to wait for a problem that may overwhelm you and then try to solve it with whatever resources are then available. The obvious explanation as to why compliance, is that some problems if ignored will tank you and your business when they finally emerge. Often, the problems of business litigation are not isolated to the business, but then bleed over into personal lives, causing further disruption and hardship that no one anticipated or expected.

Undoubtedly, the strongest argument for engaging in comppliance centers on the cost metric for you, the client. Through compliance, some sticky problems completely disappear without you suffering any additional financial or liability exposure. For example, a small change in employment practices may eliminate any future class action litigation (one of the most common threats to businesses).

Ultimately, the cost for compliance services is a drop in the bucket compared to the costs of litigation, arbitration, mediation, settlement, and discovery. Some falsely misuse statistics to prove just about any point; however, I have learned that it is an undeniable truth that clients routinely miscalculate the total cost of litigation. Litigation costs including attorney's fees during litigation usually come in at least double to quadruple what a client thought they would be at the outset. I am sure there are some cases out there that came in on/under budget, but I have yet to hear of any case like that. To further illustrate my point, if you think a lawsuit is going to cost you $50,000 (either in legal bills or settlement costs), you can almost double or quadruple that number (something like $100,000 - $200,000) to get to the real impact a lawsuit may have upon you and your business.
