There are several potential milestones that you will want to quantify your risk, for example, mediation, settlement discussions, arbitration and/or trial. Considering potential hypothetical issues associated with your specific litigation will help you understand your payout/risk at crucial moments of the litigation.

I honestly belive that if you do not have a comprehensive damage analysis it really is quite impossible to have a competent and reasonable conversation about mediating, settlement or trial.
